Damages are broken down into two categories, economic and non-economic.

Under the No-Fault Act a person injured in a car accident must first seek payment of their medical bills and/or lost wages from their own insurance company, not the person who caused the car accident. This is commonly referred to as Personal Injury Protection or PIP. Once your own insurance company pays your PIP coverage, typically $10,000.00, then you are permitted to try to hold the person who caused the car accident responsible for any additional reasonable and necessary medical expenses and documented lost wages.
Also in car accident cases, before being able to recover money for non-economic damages, a jury must determine that an injured victim must be diagnosed as suffering a permanent injury. The determination of whether someone suffered a permanent injury is based upon a treating doctor’s testimony, and objective documentation of the injury, including x-ray or MRI findings. This is the precise reason why injured accident victims must seek immediate medical care.
